Commisionning my photography services or using my photographs implies acceptance of the following:
Copyright: I retain the copyright to every image that I create, and am free to use them in any manner that I please.
Image use and Licensing: Do not assume that my giving you a high resolution file entitles you to publish it without my permission. Unless we have discussed specific publication rights, you may only use my images for personal viewing. All use of my images must be authorised on a case by case basis. When asking me to shoot for you, be very clear what usage rights you would like. If you use one of my images in a manner that I have not authorized, you will be liable for three times the appropriate licensing fee. If you're not clear on whether or not you have my permission to use an image in a particular circumpstance, just ask!
Credits: Every use of my images must be accompanied by an adjacent, clear credit as follows: "photo © Jacques-Jean Tiziou / jjtiziou.net" Online credits must link to jjtiziou.net. If you publish one of my images without such a credit, unless otherwise authorized, you will be liable for double the appropriate licensing fee for that particular use.
Use of one of my images that is both unauthorized -and- uncredited will result in your being liable for six times the appropriate licensing fee for that particular use.
Model Releases: You realize that I do not obtain model releases from my subjects; If you are going to use my images in advertising, you are responsible for obtaining model releases as appropriate. You accept all liability that might arise from your use of my images.
Data loss: You realize that digital data may become corrupted and that digital hardware may fail. You release me from liability for any claimes whatsoever based on such failure or corruption. If circumpstances beyond my control such as but not limited to fire, flood, accident, theft or hardware failure result in the loss of images, I will have no oblication to you.
Backup / Archive Retrieval: While I archive my own work, you are solely responsible for maintaining your own backup of my photographs once I have transfered files to you. You understand that if you need retrieval of files from my archives you will be subject to my current archive retrieval fees. You furthermore accept that archive retrieval may not be immediately available or at all.
Failure to perform: If I am unable to photograph due to causes beyond my control, including but not limitied to equipment failure or illness or injury, I will have no liability to you. If I fail to perform due to other reasons, I will not be liable for any amount in excess of my fee for the assignment.
Costs: If you ask me to photograph for you, you will be responsible for any reasonable costs incurred in addition to my fee and licensing costs. This includes, but is not limited to, travel costs, shipping, assistant fees, and post-production work.
Late payment: Rights to image use are not transfered until payment is made in full. Payments are due at the latest one month after the delivery of images unless otherwise specified. Late payments shall be subject to 10% interest, compounded weekly.
